Representative Actions

Thanks to the Representative Actions Directive (RAD), consumers affected by the same or similar unlawful practices from a trader can turn to an organisation that's qualified to take collective legal action, such as a consumer organisation or public agency.


How does a representative action work?

A qualified entity can decide to take legal action if multiple consumers report the same issue with a trader. The organisation will first try to solve the issue with the trader. If this does not lead to a solution for the affected consumers, the organisation can bring the case to court on the consumers' behalf. 

If the trader decides to settle or when the organisation wins the court case, the represented consumers could benefit from remedies such as compensation, product repair or replacement, price reduction, contract termination, or reimbursement of the price they paid.
